Contract Abatement occurs when a unit fails to pass an annual, or special, inspection twice. Once the unit fails the first inspection, the landlord will be given a deadline to correct the failed items. Failure to correct the documented deficiencies will result in the contract abatement.
Once the unit enters abatement, the Housing Assistance Payments (HAP) will stop. The abatement will last up to 60 days or until the failed items are reported, and confirmed as corrected. For everyday that the unit is in abatement (up to 60), the HAP is permanently forfeited.
If the correction is made within the 60 day abatement period, the landlord is entitled to the HAP going forward; as the contract is no longer in abatement. If the abatement lasts a full 60 days, the contract will terminate and no future HAP will be paid for the contract.
Tenant's are still responsible for their portion of the rent (if any) during the abatement period. Tenant's will be offered a voucher to relocate once the unit is in abatement. If the tenant remains, and the contract terminates, the tenant is responsible for the full contract rent.
